PROEXPORT forms its companies in the implementation of a model of crime prevention
The Association of Producers-Exporters of Fruits and Vegetables of the Region of Murcia (PROEXPORT) advocates the implementation of the model of crime prevention among its associated companies and, among the actions undertaken for this purpose, has held an informative day, imparted by the consulting firm PricewaterhouseCoopers (PwC), to examine how to prevent criminal liability of legal persons and analyze the risks in the sector.
The director of PROEXPORT, Fernando Gómez, recalled that “with the reform of the Penal Code in 2015, a regulatory framework was approved that establishes the possible responsibility of companies for crimes committed by their employees, managers or administrators within the organization. In this sense, we are proactive in encouraging our companies to reduce that risk of criminal responsibility or even to be exempt from it, by establishing within them a model of crime prevention that effectively monitors, controls and prevents their commission”.
Proexport has relied on the international firm PricewaterhouseCoopers (PwC) to train its companies in this matter.”all companies face different criminal risks because of the activity they carry out”, has been pointed out from this consulting firm. “According to the regulations, a legal person may be exempt provided that the management body has implemented this model and that the supervision of operation and compliance is entrusted to an autonomous body within the company”, explained María Sanchez, associate Senior of the PwC Procedural Department in Murcia.
In the case of agricultural enterprises, PwC recommends implementing a preventive model of possible crimes against the environment, public health, workers’ rights, Social Security and Public Treasury, fraud or contraband offenses in the import or export activity
Having crime prevention models that establish the necessary protocols to deal with these risks “means for PROEXPORT companies a mechanism of transparency and reputation that we are sure will bring reliability to their customers, suppliers and society as a whole. It is highly valued nationally and internationally, especially in the field of food where it is very appropriate in the face of so many areas in which companies can be affected”, said María Navarro, PwC partner in Murcia.
